Step 1: Name Approval
The NY Department of Financial Services (DFS) must approve your entity name before you can proceed.

Email name.approvals@dfs.ny.gov with the following:

I am requesting entity name approval for a non-resident firm license application in New York.
- Applicant Name: Your Name
- Entity Name: Your Company

DFS will respond with either a Name Approval or instructions for obtaining a Fictitious Name Approval if your true name is not available.
Step 2: Application for Authority
File an Application for Authority with the NY Department of State to register your business as a foreign entity.
Choose Your Entity Type
- Foreign Business Corporation: DOS Application for Authority
- Foreign LLC: DOS Application for Authority
Prepare the Required Forms
- Cover Sheet -- Download from DOS Forms (2183-f). Write "Application For Authority" on the Document Type line.
- Credit Card Authorization -- Download from DOS Forms (1515-f). The filing fee is $275.
- Application for Authority -- Use the form for your entity type:
- Corporation: Form 1335-f
- LLC: Download from the Foreign LLC page
- True Name Denial Letter from DFS (received in Step 1)
- Fictitious Name Approval Letter from DFS (if applicable)
- Certificate of Organization from your home state
- Certificate of Good Standing from your home state

Fax all documents to +1 (518) 473-1654.
Step 3: Upload Documents to NIPR
Once you have your approvals, upload the following to the NIPR Warehouse:
- Department Name Approval letter (from Step 1)
- Department of State filing receipt (from Step 2)
- Business organization documents:
- Corporation: Charter or Certificate of Incorporation
- LLC: Articles of Organization
- Partnership: Business Certificate from County Clerk
- Letter of Certification from your home state
Step 4: Complete DRLP Background Questions
After submitting your documents, the NY Department of Insurance will pre-approve your application. You will then need to:
- Log in to the NY DFS NIPR Portal.
- Complete the DRLP background questions for your designated responsible licensed producer.
